Josh Rand: Absolutely, Brad. As we mentioned in a previous video, in Georgia, once a foreclosure takes place, you no longer have the right to redeem the property. However, federal law mandates that the mortgage company provide you with a 90-day notice to vacate. During this time, you essentially become a tenant in your own home. After the 90 days, you might be asked to pay rent or face potential eviction.
Brad: That’s right, and in some cases, lenders might offer what’s called “cash for keys.” This means they might pay you a certain amount to move out voluntarily. It’s not ideal, but it could provide you with some funds for a new living situation.
Josh Rand: Exactly, Brad. While it’s unfortunate that the foreclosure has reached this stage, cash for keys can be a small silver lining.
Brad: We’ve seen this happen quite often after foreclosure. Lenders want to sell the property quickly, so they might offer an incentive to get you out sooner. It’s important to remember that the 90-day notice is a federal law, applicable in every state. So, even if an investor buys your property at auction and demands you leave immediately, they cannot legally do so.
Josh Rand: That’s correct. In Georgia, eviction guidelines and rules must be followed. After foreclosure, you become a tenant, and your rights are protected.
